Release of liability

All participants in any classes, rehearsals, performances, or activities by Moodment Dance LLC, hereby referred to as Moodment Dance, must agree to and adhere to the following Terms and Conditions to participate. By booking with Moodment Dance and by participating, I acknowledge and agree to all of the Terms and Conditions listed and described below. 

Release of Liability and Acknowledgement of Risks

 

Moodment Dance classes are recreational in nature and are for educational and entertainment purposes only. Classes are not a replacement for professional health, wellness, fitness, or medical advice. I understand and agree that in participating in any dance class, workshop, rehearsal or performance, there is a possibility of physical injury or death. I voluntarily agree, therefore, to assume all risks and responsibility for any such injury, or accident, which might occur to me or my child, or my guests during any of Moodment Dance's classes, rehearsals, performances, or activities. 

I also exempt, release, and indemnify Moodment Dance, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, shareholders, partners, members, officers, directors, contractors, consultants, agents, and representatives, and/or students from any and all liability claims, demands, or causes of action whatsoever from any damage, loss, injury, or death to me, my children, or property which may arise out of or in connection with participation in any classes or activities conducted by Moodment Dance. 

I further hereby voluntarily agree to waive my rights and that of my heirs and assigns to hold Moodment Dance, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, shareholders, partners, members, officers, directors, contractors, consultants, agents, and representatives, and/or students liable for such damage, loss, injury, or death. I understand that I should be aware of my physical limitations and agree not to exceed them. If I am signing this waiver for my children, I certify that I am the parent or legal guardian and have the right to waive these rights. 

I have read, understood and agree to be bound by the above statement. By booking, purchasing, or participating in Moodment Dance Services, I effectively virtually sign this agreement. 

Refunds

 

Recurring payments may be canceled at any time. Cancellation must be made in writing prior to billing date. There are no refunds for one-time or recurring payments. Please contact us at info@moodmentdance.com with any questions.

 

Video Access 

Customers will have access to videos for a limited time. Videos are for customer personal use only. Videos are not to be copied, shared, altered, reproduced, reused, or used outside of Moodment Dance website or social media accounts, and may not be used for profit or commercial use. All videos are copyrighted and are the sole and exclusive intellectual property of Moodment Dance. 

Class Participation 

All participants are must agree to treat other participants, including Moodment Dance staff, with care, kindness, and respect. Moodment Dance reserves the right to terminate participants access and membership for any reason. Participation and membership access can be revoked at any time for any reason. All classes are for adult participation unless otherwise stated. 

All participants must warm-up before participating in dance activities. A warm-up is provided at the start of the class. Arriving late is strongly discouraged. Participants arriving late will be responsible for completing a warm-up before joining the class to decrease their risk of injury. Late arrivals of more than 10 minutes will not able to participate in the class and will need to reschedule. 

Children's Class Participation 

Only children are allowed to participate in children’s classes. Children under age 13 are required to be supervised by a parent or guardian adult while participating in any Moodment Dance class or activity. By booking a children's class or activity, you agree to provide supervision by an adult who is authorized to provide care for the child while participating in the class or activity. Parent and/or guardian names and contact information are required to be listed on file with Moodment Dance. Parent or guardian is responsible for reporting updated parental information to Moodment Dance immediately. 

Video and Photography 

No photography or video recordings of Moodment Dance classes are allowed either online or in person. 

Moodment Dance reserves the right to record video and audio of classes and post video and audio of classes online for member access. 

Cancelation Policy 

Cancelations are accepted no later than 24 hours prior to class or service start time. Clients may book a make-up session within the month. However, there are no refunds. Cancelation must be done in writing by email to info@moodmentdance.com

Class Registration 

All participants must register for online classes no later than 24 hours prior to the scheduled class start time. 

Class Cancelations 

Moodment Dance strives to keep all classes running as scheduled. However, class cancellation may occur for unforeseen reasons. In the case that an instructor must cancel a class, all participants registered for the class will be notified and may reschedule the same class for a later time. 

Performances 

All participants in Moodment Dance activities or performances may be required to agree and sign a separate Terms and Conditions document to participate. 

By purchasing services and by participating in Moodment Dance classes and activities, you agree to adhere to all of the above Terms and Conditions. Violations of these terms and conditions may be subject to remedy in a court of law. 

Applicable Law

Any legal or equitable claim that may arise from participation in the above shall be resolved under California law. 

Dispute Resolution

The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below.

Alternative Dispute Resolution (ADR) procedure

 

Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction.
